Games that finished development longer than a decade or so ago should be FOSS, but IP holders shouldn’t have to preserve them themselves. Devs should be making new games unless they have a personal passion for preserving, which enough of them do. EA Games should be dissolved. Embracer should be dissolved. Activision/Blizzard dissolved.
